オープンソースソフトウェア使用許諾条件書

 

 

ゲートウェイには、オープンソースソフトウェア(以下「OSS」といいます)が含まれます。OSSに関しては、本条件書がカスタマーポータルサイト利用規約に優先して適用されます。

 

1.    オープンソースライセンス

OSSについては以下のライセンス条件が適用されます。OSSの中に含まれるファイルにおいて、別の版や追加のライセンス条件を指定している場合は、当該版や追加のライセンス条件が優先的に適用されます。

2.    保証の制限

OSSは、現状のまま提供され、横河その他のOSSの提供者やライセンサーは、明示、黙示を問わず、権利、非侵害、商品性、特定目的への適合性を含め、一切保証責任を負いません。

 

3.    責任の制限

カスタマーポータルサイト利用規約または本条件書の他の責任制限条項にかかわらず、横河、横河の関係会社およびこれらへの供給者は、OSSに関し、第三者からのクレーム、権利侵害、不良、データ喪失、直接損害、間接損害、結果損害、特別損害、懲罰的損害その他の損害について、一切責任を負いません。これらのクレームや損害について、横河、横河の関係会社または供給者が事前に通知を受けていた場合も同様です。

 

4.    ソースコードの提供方法

GPLが適用されたソフトウェアについては、GPLの条項に従い、お客様は、当該ソフトウェアのソースコードを入手し、再頒布および/または改変することができます。LGPLが適用されたソフトウェアについては、LGPLの条項に従い、お客様は、当該ソフトウェアのソースコードを入手し、再頒布および/または改変することができます。Eclipseが適用されたソフトウェアについては、Eclipseの条項に従い、お客様は、当該ソフトウェアのソースコードを入手し、再頒布および/または改変することができます。

該当するソフトウェアのソースコードは、お客様からのお申し込みに応じて提供いたします。ソースコード提供時に発生する費用はお客様のご負担となります。また、ソースコードの内容等についてのご質問にはお答えできませんので、あらかじめご了承ください。

  b) Subject to the terms of this Agreement, each Contributor hereby grants

     Recipient a non-exclusive, worldwide, royalty-free patent license under

     Licensed Patents to make, use, sell, offer to sell, import and otherwise

     transfer the Contribution of such Contributor, if any, in source code and

     object code form. This patent license shall apply to the combination of the

     Contribution and the Program if, at the time the Contribution is added by the

     Contributor, such addition of the Contribution causes such combination to be

  infringes such Recipient's patent(s), then such Recipient's rights granted

  under Section 2(b) shall terminate as of the date such litigation is filed.

 

  All Recipient's rights under this Agreement shall terminate if it fails to

  comply with any of the material terms or conditions of this Agreement and

  does not cure such failure in a reasonable period of time after becoming

  aware of such noncompliance. If all Recipient's rights under this Agreement

  terminate, Recipient agrees to cease use and distribution of the Program as
